In the UK, reform of the Electronic Communications Code (ECC) was intended to accelerate roll-out by enabling more exhaustive coverage and greater capacity, particularly for 5G. In practice, operators have relied on the Code to achieve significant rent reductions, while property owners have resisted.
Since the introduction of the 2017 Code, there have already been more Tribunal decisions than in the entire 30 years under the previous Code and Telecoms Act, and the Tribunal has repeatedly warned against delays. Recent amendments under the Product Security and Telecommunications Infrastructure Act 2022 (PSTI) address some of the concerns raised by the ECC; however, they have not yet delivered a smoother rollout.
